I totally agree with you GC_hoga_re...The desi consulting companies are one of the main reasons for fraud and problems with H1-B.I do not imply that all companies do that. But we all know majority of them have this modus operandi
1) They file blanket H1 applications..no wonder 65000 visas go out in a day
2) They give "Job requirements" to the H1 Consultants and the consultants tailor make there resumes, putting a lot of fake job projects and technical skills(In some cases the entire resume is fake)..After few tries, the consultant is able to find a project, he/she can work on.
I have sen it with my own eyes how efficient are these companies in faking a resume.and arranging fake references.
3) The desi consulting companies usually go through a direct vendor(tier 1) for the projects, for they rarely have resources and contacts to do it themselves. In many cases there are 3 or even more layers in between. The end result is that the H1 consultant gets very little in his/her hand, sometimes only slightly higher than minimum wage for H1b. The hiring manager gets the cut from the tier-1 vendor. The tier-1 vendor gets his cut and so does the desi companies.
Fact of the matter is, the starting billing rate is same (i.e. this is the rate a US Citizen or a Permanent Resident have paid by directly going through the Tier1 vendor), the H1 person gets very little and the desi companies get a big cut just because they have sponsored the H1 and not because they have some real ongoing projects creating unique products or services and generating revenue.
I bet if most of these desi companies financials are audited, there 95% revenue would be from the payments from these Tier1 vendors(American companies), who are known in the market as placement companies.
4) The Tier-1 vendors know that getting an H1B consultant through a desi consulting company is a lot safer because that consultant will be under a tight leash, cannot leave the project on a very short notice (as a US Citizen or a PR would do) and they don't have to deal with all the headaches of paying the H1B consultants on the bench.
Thus if the client company allows it, they would most probably go for the H1B consultant. This ofcourse pisses off US Citizens and thus we have this situation.
I am a H1B myself. But I would really like these things to be taken cure off. If I have to pay a price in terms of stricter enforcements, so be it. Atleast this whole system of lies and bloodsucking leeches would be cleaned up.

I have lived in US for over a decade and between me and my friends we must have seen atleast 50 consulting companies and not a single one of them was honest... I actually know a friend who owns a small consulting company and the tactics he uses are simply appalling. He brings people on fake degrees, changes their resumes and places them in different resumes... When he changes their resume its not minor changes... He puts degrees like MS (comp sci) from a good school, when all they might have is a BE civil from some junk college in India. He pays them crap and exploits them for years... I had confronted him a couple of times and accirding to him he was doing them a favor by bringing them to US! No wonder the H1 quota is filled up on day 1!! I wish they had passed it long time back... A lot of problems would be solved if these companies were to shut down... There might be some pain to begin with, but over the long term this is good for everyone! And people who say that it will increase outsourcing... well outsourcing is here to stay and nothing can change it... WASHINGTON � A coalition of top Senate Democrats laid out the contours of a proposed overhaul of immigration laws on Thursday � and appealed to Republicans to join them in pursuing it � even as doubts mounted about the prospects of winning approval of legislation this year.
Under the outline of immigration changes drawn up by Senator Charles E. Schumer of New York, the No. 3 Senate Democrat, the federal government would enhance border security and create a new fraud-resistant Social Security card.
Illegal immigrants who wish to remain in this country would have to admit they had broken the law, pay back taxes and fees, and pass a criminal background check to qualify for legal residency after eight years.
�Our immigration system is broken,� the majority leader, Senator Harry Reid of Nevada, said late Thursday afternoon at a packed news conference. �We�re offering this framework as an invitation, an invitation to our Republican colleagues to work with us to solve this problem that has plagued our country for too long.�
Even as the Democratic senators were still speaking, President Obama issued a statement praising the proposal as �an important step,� and he warned that lack of federal action would �leave the door open to a patchwork of actions at the state and local level that are inconsistent and, as we have seen recently, often misguided.�
Mr. Obama�s statement was a reference to the tough new law recently enacted in Arizona that many Democrats view as draconian and that helped prompt Democrats to take on the immigration issue sooner than some had planned.
�What has become increasingly clear,� Mr. Obama said, �is that we can no longer wait to fix our broken immigration system, which Democrats and Republicans alike agree doesn�t work.�
The statement contrasted with comments he made to reporters a day earlier on Air Force One, in which he suggested that Congress might not have the appetite for an immigration overhaul.
At the news conference, Democratic leaders said they were presenting the legislative framework in hopes of persuading Republicans to collaborate on the issue. They are also looking to sound out skeptical Democrats to gauge the prospects for support.
House Democrats have said they will not act unless the Senate moves first.
Mr. Reid, who is facing a difficult re-election fight back home, first put the issue back on the Congressional agenda a few weeks ago when he told a pro-immigration rally in Las Vegas that he intended to pursue legislation, a stance that caught many in Washington off guard.
Senator Lindsey Graham of South Carolina, the chief Republican negotiating with Democrats on the issue, dropped out of the talks, saying he was angry that Mr. Reid seemed to be giving immigration priority over a climate bill.
At the news conference Mr. Reid said it was �not logical to use immigration as an excuse to not help on energy.� But he also said Democrats were not directing their message at Mr. Graham.
�There are 40 other Republicans,� he said.
On Thursday, the House Republican leader, Representative John A. Boehner of Ohio, flatly predicted that Congress would not send an immigration measure to the president this year. Mr. Boehner accused Democrats of engaging in a �cynical ploy to try to engage voters, some segment of voters, to show up in this November�s elections.�
�There is not a chance that immigration is going to move through the Congress,� he said.
But Mr. Schumer, who is now chairman of a subcommittee on immigration long headed by the late Senator Edward M. Kennedy of Massachusetts, said he believed there was a possibility of success.
Mr. Schumer hailed his approach as a way to combine border security and improvements in the American work force while providing a chance for millions of people living illegally in the United States to gain legal status and pay taxes.
And Mr. Schumer, who is known for his ambition in both the political and policy arenas, drew loud laughter when he said that he would not have accepted the subcommittee gavel if he had thought otherwise.
�If I did not believe we could accomplish immigration reform, I never would have chosen to accept the immigration subcommittee chairmanship,� he said. �Committees of inaction and legislative backwaters are not places in which I thrive.�

He had lost 2 years of college education and fees because in Canada, they did not give him all the credits he earned here in US. My 2nd son is also getting there and he will be 21 in June 10. I am sure he should be fine as we have filed his I 485. I feel bad about all the kids going through this situation and will send the faxes as suggested today and hope for a positive outcome of this bill..

Rameshvaid, you are right the Dream act (as it is now) will not cover the legal kids. However, what we are trying to do is raise awareness and get people to gather together in support for including a provision for the legal kids into the bill as an amendment. It could be anything like "also to include children who are beneficiaries of an EB based GC application and have been waiting for more than 5 years and have fullfilled all requirements that are stated for the illegally present kids to be considered for a GC".
But for that to happen, we need to get enough number of people here (particularly people like you who have experienced/ experiencing this problem) and then as a BIG GROUP take action.
Individually calling/faxing might/might not make any effect as Pappu mentioned.
Please let us first gather more people.

Not in genuinely serious issues but threads like "who will be the Next Indian PM, what will be CIR be like, What is May bulletin going to look like" etc. These are threads intended to release pent up frustation and primarily for chatting with other people. My attorney called National Customer Service after the 90 days of filing. They told him that he has to wait 15 more days, and if no actions, call again, so they can begin an investigation. He called again, and the customer service representative told him that an e-mail would be sent to the Service Center where my case was sent and gave him the confirmation #.

Affidavit of support has to be signed by the primary applicant i.e. the beneficiary of the 485.
How can the primary applicant support himself on an affidavit when he is being sponsored by the employer? It perfectly makes sense for spouse or children. Are you saying that the affidavit is needed only for spouse & children? The employment letter from the employer is enough for the primary applicant. Is that right?

This morning, at around 09:13 AM PT, I received a couple of text alerts on my Mobile saying the status of our AP petitions had changed !!! With prayer on my mind, I logged onto USCIS website and was happy to notice that both our petitions had changed from 'Initial Review' to 'Document Production or Oath Ceremony'.
I am aware that, we aren't yet out of the trenches yet as anything might happen until the time we actually have the AP document on Hand...But I am believer and I hope for the best and I guess, the major hurdles(approval) have been crossed...
At least, Now I do not have to cancel my flight tickets scheduled for November 27th !!! :)
Here is the complete timeline.
Date the AP Renewal application sent from my Attorney's office: 10/20
Date received at USCIS, Nebraska: 10/21
USCIS Notice Date: 10/21
USCIS AP Renewal approval Date: 11/16
Total Time USCIS took to arrive at the decision: 18 Business days.
I am sure there are a couple of other folks who are waiting on AP for their trips...Good Luck to them...

I hope I receive mine soon. Ours was sent on 10/16 and received on 10/19 at NSC. Receipt date is 10/19. Just like yours there were soft LUDS on 11/12 and 11/13, but the case status still remains Initial Review. Keeping my fingers crossed. Traveling on the 28th of this month. Wish me luck...

As per the instructions on I-134 and I-864 none of them SHOULD be required for employment based 485. I-134 is for visitors to US; I-864 is for family based and some cases of employment based 485(where your relative owns part of the company sponsoring you).
But based on their previous experience with RFE about these, the lawyers ask you to fill one of them as a preemptive measure to avoid an RFE.
If filing on your own, it's your call what you want to do. We decided to send I-134.

Hmm.. so you are saying that you mention your bank account numbers in your US tax returns? I don't think so.
I think asking account numbers is invasion of privacy. They can ask the amounts and the name of the banks, but not the account numbers !

Friend's freind is only one degree of separation, shouldn't be that difficult for you to get their contact information. I can see this building up as a way of bilking some money from the IV community.
If your "friend's friends" did not consult a lawyer after being let in for 15 days, they are the biggest goddamned fools on the face of this earth and probably deserve to be deported.
IV core, please stop this kind of posts, unless there is a FIRST hand expereince.
Till now since the start of this thread, not a single person has approached IV with his first hand story with his name and contact information so that we can work on it. No lawyer has also contacted us about this and forwarded incidents faced by their clients.
I believe this is a rumor unless proved otherwise.

IV's agenda needs to be re-adjusted to push for Citizenship (instead of EB Green cards). 2M new voters automatically gets politicians excited. Why do you think the Hispanic base gets so much press - they're a vote bank
I'd strongly recommend lobbying for Citizenship for (let's say) X years legally in this country with proof of taxes. Why do we think congress would push EB green cards in this economy ? Plus if the older ones get out of the visa pool the visas flow into the newer ones
