That was an interesting article from numberusa about their little victory but they must be aware of the fact that highly skilled immigrants like us are not going to watch them run the show from now onwards.We have shown them what we are capable of when we reached every nook and corner of the capitol hill last week even prompting the numbersusa to drop their "we are making progress" message from their website.We also have nailed bit by bit for every post that was addressed to us in the S.report website.

I completely agree with you that only reasonable increases in the benefits we are seeking will have any chances of getting through. Since we (folks stuck in GC process) are fighting for reducing retrogression, I am not even sure why we would ask for increase in H1-B. How does increasing H1B help us get our GC faster? That is something that companies who need H1Bs should focus on. In fact, increasing H1B will most likely hurt us by increasing the number of people in the GC line and by drawing attention from anti-immigrant group. We are shooting ourselves in the foot if we are asking for more H1B.

text of bill as passed by senate will likely be available on thomas.loc.gov tomorrow or soon.
Looking at the current text it looks to me to be for 2007 tax year, payable 2008.
In that case I will either file for extension for filing until me and my wife get GC, or file for an EAD for her, or wait see if my SS is enough and that her ITIN does not disqualify me with SS. For those unable to get EAD it may be possible to still get GC because SS admin will under a few circumstances issue SS rather than a letter saying not available when obtaining a benefit requires SS. That argument would require you earn $3000 in income without working, so unless you earn a lot on savings or capital gains etc. that argument wouldn't fly.
Let's look for the text on thomas.loc.gov when it is available.
Finally since http://www.alipac.us organized the ITIN effort, you can always ask them to pay you the rebate! After all they claim to be for LEGAL immigrants!

May be we can all discuss the ifs and buts in a group meeting. In the same token, please do not throw off the work done by people in Washington with negative rhetoric. All of us are in this and contributing to IV, knowing full well that IV may or may not succeed. This is not a business proposition. Look at it as more of an awareness campaign for our issues. It all depends on the Senate and Congress to work out a solution to our grievances in a bipartisan manner. And we can definitely help there by meeting them locally and stressing out our needs and explaining our problems.

In current congress, only 15 Senators and around 100 HR are not incliend to have more H1B and more GC. .

What was your backup plan if they insisted on ATV?
I had emailed Houston consulate 3 times and every time got a reply saying No ATV required. I had a printout of the emails with me, incase they asked me about ATV. If they would still not allow me, there was nothing that I could do other than rescheduling the travel and going to Chennai for a ATV.

This whole MESS is like Schindlers List.. it’s a scam of monumental proportions..
Its like modern day slavery…earlier it was the Africans chained to do labour ..now its the third world country citizens who are facing the bonded labour trauma!!! (
The game plan is very smple: Get as many foreign (asian, third world country) students on F1—(desi, Chinese..)..entice them with an EAD for a year..then 6 years of H1..when are well settled .. lure them with the hope of a GC…and an endless wait!
If you have only 3500 GC per year..then da*& it give only 3500-F1 visas ..why do u need 70000 desis coming here to study! They want to keep their colleges going..so lure the cattle from the third world.
UR meaningless letters will not bring about a change of heart .. its a systematic dependency that is deliberately created..I am not shooting down these efforts but its totally vision less!! And not worth the effort!!!!

(an approach)For the short term people with a law background can analyze the existing laws to see if we can get an adminstrative solution. Just like DOL/USCIS were able to interpret the law to change the visa alocation process, i am sure some of the enterprising ones amongs us can devote some resources to find out if there is an adminstrative soultion to the problem.

why does Air India have Newark to Mumbai requiring ATV?. Mumbai to Newark is understandable, but if you are going to India, why do you need an ATV.

if you remove the limitation to tech workers, almost all of us would have our gcs by now.
does this mean numbers is not our enemy?
how about we align ourselves with them? :) I would only ask te reduce the 3 year requirement to 2 years.
dont shoot me if there is some fine print I missed.
actually norm matloff, who aouthored this reform to H-1b proposal, is not all bad. It is not totally unfair and makes sense.

I don't see any fine print. When I was employed, there was documentation to show that I was the most qualified for the job, and, of course, that I was earning above the median wages for that job.
This might be the best thing to happen to H1B. Maybe if we agree to this and tell them so (I can't believe I am suggesting this; please don't ban me :)), they will not oppose us again.
