Our Pd is Oct 2005 - EB2 - NSC Center - July filer
Our EAD got renewed and AP is still pending.
One Doubt i have is there was a LUD on 7/27/2008 on our last year AP, this is been approved long back what does this mean?. However no LUD on 485.

Finally...exctly after 4 months my all checks got cleared today , and got receipt number from the back check image.
Only do't know 140 as it was employer's check.
Just to Recap
Sent 140/485/765/131 on Aug 3rd to NSC
SR opened on 11/5.. IO said it must have been transfered to TSC
Fax sent on 11/28
Check cleared on 12/3 .. Receipt # from TSC.

There is absolutely nothing wrong in getting into EB2 cat, but you have to evaluate yourself. At least GC process is just not about doing an interview and completing a task in hand.
I wish EB2 had much tougher criteria in the first place. Otherwise it wouldn�t have been the way it is.
There is something called accreditation, be it in US, India or anywhere. Everything you do or read can not be considered a degree.

We all know that the h1b system needs to be fixed.
Before you bash consulting companies or say tier 2 or tier 3 universities, try to look into the bigger picture. There are genuine consulting companies and there are genuine people making $100 per hour + through consulting companies, people study in top univs also join consulting companies. A lot of people come here through a small conssulting company, they later move to Microsot of Google any other client where they are contracted
Remember the IT industry is an industry with high demand, if people are available it is because there is requirement, requirements can be in form of temporary jobs, permanat jobs etcc... A lot of people prefer consulting because they can move between projects and get better exposure and their resume builds - after a while they can be in a commanding position.
It is very much American if you are consulting, a lot of Americans work a independent contractors, working 9 months an year and vacationing 3 months. So there is nothing wromng in it.
So please look at the bigger picture before you hate something or someone. Fulltime jobs are not very steady and - layoffs are common - so please do not assume that a fulltime job is the best option.
Consultants are interviewed by the team before they are hired, just like fulltime employees, so if consultant does not perform well, he is not retained by client.

i have heard from a member who knows of a friend whose checks were cashed last weekend. I have not posted details about it because there is no way to verify for sure.
I agree , we should just ignore this.Although such a thing would never happen , but it if does then there will be much stronger opposition & protests.They better learn somthing from last fiasco.

what you say is ideal but not practical. After all, the tech and healthcare industries are the ones driving SKIL .. they cannot do without H1-B visas for the next 14 months so they will see to it that either the bill contains H1-B increases or there is no bill at all. They will prefer to wait and fight another day.

If at all they clog the GC queue even more, it will be 2-3 years down the line before they will be sponsored for permanent residency.It is not like 245i where they will break into our line.

The memo was released by USCIS on May 06, 2009 which is relatively new since none of us from the community caught it. So I don't believe that the attorney was trying to create a panic, but it was his intention to sperad the word.

Most of us won't fall under this category.
Again on page 33/34 there is an example of AOS family based application.
As per that example, assuming that applicant was unlawfully present before AOS application, if USCIS accepts I-1485 application and issues a receipt notice, he/she is in legal status even if I-485 ultimately gets rejected.

Please help the plight of young adults admitted to the United States LEGALLY.
Senators Durbin and Lugar are co sponsors of the recently re-introduced DREAM act to the senate. This bill was devised to by Senator Durbin to provide a path to permanent residence (Green Card) to the children of parents who entered the United States ILLegally.
This bill overlooks the plight of thousands of young adults who also entered the United States with their parents when they were minors who have AGED OUT. The legal immigration system is a slow process and if a child turns 21 before they can apply for a green card as part of their family unit they disappear into an immigration �black hole�.
The DREAM act effectively provides the children of those who broke (ignored) immigration laws with a path to citizenship while excluding those who respected the immigration laws.
I am asking that LEGALLY admitted young adults are included in the DREAM act.

My wife and kids will be traveling next week to India via Frankfurt. They have approved AP. H4 visa has expired on the passport. Last when I checked the German consulate website about 2 months ago, it said that under exception 4 for India, we don't need a transit visa since we have an approved AP.
Now the website does not mention about AP at all, only unexpired visa or GC for no transit visa.
Any recent experiences for travel by Lufthansa through Frankfurt on AP.
Please share, as we do not have enough time to apply for transit visa now.

Hate to be the party pooper, but its better to see the reality than be lost in the illusion.

We a have bitterly and an acrimoniously divided Congress
The democrats are NOT together on this one i.e blue dogs, conservative Dems etc.
We have game changing mid terms coming in.
Democrats DONT have super majority in the Senate any more.

Show me one time in history when the congress was not divided on a controversial issue? Don't worry about the conservative democrats because at the end of the day that deficit can be overcome by getting republicans in both house and senate.
As I said, Republicans in senate will kick and scream, throw a bunch of tantrums like 2 year olds, but in the end, they know that they will have to come on board to keep their own seats - and there is no language they understand better than losing voters.
And MOST of all we have a president who has PUBLICLY said that this bill will not pass this year due to the lack of political clout.
And if he had publicly said that this bill would pass, would the republicans and conservative dems line up to vote for it?
This is just a ploy to rally up the hispanic votes by Reid, don't pin too much/any hopes on this, the writing on the wall is unfortunately very clear, not worth the heart break. :(

People who have applied online...did you get the finger prints notice. We applied on 10/18 and the status is Initial Review. we got the reciept notice in 2 days.
I had applied online in last week September and got approval notice and AP docs last week. I did not have to go for FP. My last FP was done Nov 2007.
