Below is some updates from http://www.immigration-law.com/
09/22/2006: House Passed Three Enforcement-Only Legislative Bills
House was very busy yesterday to pass the enforcement-only bills per Rep. Sensenbrenner agenda. The bills include:
H.R. 4830, Border Tunnel Prevention Act of 2006
H.R. 6095, Immigration Law Enfocement Act of 2006
H.R. 6094, Community Protection Act of 2006.
Next week, the Congress will witness a drama to sweep all of the border-security only and the enforcement only bills into the DHS Appropriations Bill, probably through the conference process.
09/21/2006: Immigration Legislation Battle Moves from CIR to DHS Appropriation Legislation
Congress has only little more than a week left before its scheduled recess and with the death of CIR, the Republican Congress has been busy to pass highly election politics charged border security only and enforcement only legislative bills before the recess. The House has already passed so-called Voter ID bill by 228:196 and the Senate voted the Border Fence bill by 94:0 which has already been passed by the House. This latter bill is expected to pass the Senate next Monday.
Republican strategists intend to add these bills to the DHS Appropriation Bill which must be passed by the Congress. There is also ongoing movement to add legal immigration bills to the Appropriation Bill. The Republican strategists has reportedly obtained the President's coimmitment to sign the bills once these bills are passed, but such strategies are strongly opposed by the immigration interest groups including AILA and there is a massive lobbying to block such legislation. The Republican strategists also face unexpected internal opposition to such strategy by Senate Appropriations Committee Chairman Thad Cochran (R-Mass) who reportedly stated that he would not add any legislaive language onto the spending bills that could slow their progress in the final days before the coming recess.
Can somebody please write something in layman terms instead of copying pasting articles.
Questions
1. Why AILA is against adding legal immigration reforms ?
2. What is the deadling to add amendments ?
3. What are the current chances for legal immigration amendments to be inculded ?

My wife and son have a H4 VISA and use ITIN for tax purposes. I have SSN, my tax
consultant told me that if any person in the family had ITIN then the entire family is
not eligible for the tax rebate that was announced in the year 2007. Is this correct?

I talked to IO and according to her, applications will be processed only if the visa numbers are available. If all applications have been processed for which visa numbers were available than they will process by RD. So, even if the cut off dates for processing the applications is July 16th at TSC, they will be processing only EB-2 applications based on RD till end of August. As and when the application processing is complete they will be assigned to IO and visa number allocated. If the processing dates are past receipt date than they will be given visa numbers shortly.

Called all - everyone was courteous and said they would convey the message
Most democrat members aides said they were in favor of the bill
Most Republican members aides said they did not know the position
Steve King (R-IA)'s aide said he is opposed to all forms of immigration and so opposes the bill!!

We can keep blaming Mr. Durbin this, Mr. Durbin that. He won't change his views unless we motivate him to.
IV members in Illinois need to approach Mr. Durbin in good numbers and motivate him to change his position. Why do you guys think he's sympathetic to "undocumented"? They approach him everyday with their issues. He knows there are a whole "lot" of them in his constituency. He has a vested interest in seeing they become citizens, so that his future political career is strengthened.
Let's say 400-500 H1B GC applicants [ There should be thousands living in IL] approach Mr. Durbin - TOGETHER as IV members ; he will definitely listen. If that's followed by thousands writing regularly to him; he will surely do whatever he can do to accomodate "future voters" in his constituency - be it dropping some of the more draconian measures, softening his opposition to SKIL etc.
Right now, it's just 'Programmers Guild' , and other like minded labor unions, that have been talking to Mr. Durbin. They have probably been approaching him in greater numbers, through lobbyists, even making campaign contributions [ which we can't do].
There's also this wrong image in the minds of Democrats, especially those with labor backgrounds, that Highly Skilled Immigrants tend to lean "Republican". This also needs to be kept in mind while approaching Senators like Mr. Durbin. If I were to talk to him, this is what I would say
1) Foreign workers do not depress wages. Insufficient Visa numbers, the flawed GC process that takes years to complete and forces workers to remain with same company at the same position in a resricted salary range etc. keep wages depressed for Foreign workers ( as well as the whole job market). Measures that punish Foreign workers for the flawed Immigration laws is like throwing the baby out with the bath water!
2) Right way to tackle the situation is to improve Immigration laws to make the GC process faster by increasing the numbers, transparent, tougher laws against employers/lawyers that game the system and abuse the workers, remove anti-worker provisions and provide increased job mobility to workers in changing employers, getting promoted to higher positions.
3) Need to eliminate Country quotas that promote discrimination on the basis of National Origin. There is no basis for Mexicans, Philippinos, Chinese and Indians to be forced to remain at the same position, same employer, same salary for years; just because they happened to be born in the "wrong" country by chance.
4) Commend Mr. Durbin for proposed H1B/L1B whistle-blower protections. Commend him for a pro-Immigrant DREAM act and requesting him to extend it to kids of Immigrants waiting for the GC who face dire situations due to "aging out". Also express hopes that Mr. Durbin will continue to take up legislations that benefit the whole immigrant community.
As long as there aren't enough people from Illinois, especially a H1B-rich city like Chicago, approaching Mr. Durbin and explaining our case - in the terms he understands and appreciates; there is no point in blaming Mr. Durbin to anti-H1B. If he is, it's because we have been silent and he's listening only to PG and such groups in good numbers ( while legal immigrants may have approached in smaller groups)
There should a concerted effort to raise a strong local chapter in IL, educate H1Bs on the laws that threaten their continuation in US/GC process etc., make them meet Mr. Durbin in greater numbers, write to him in greater numbers, keep calling him etc., until he changes his position. That's the only way to change things in a democracy.
this is a wonderful idea. IV can we plan an exercise say web fax, calling up durbin's office something like that to reach senator's durbin office

it is 3 years continuous period immediately preceding the I-485 application
As per the current wording
"Aliens who have earned and advanced degree in STEM and have been working in a related field in the US under a nonimmigrant visa during the 3 year period preceding their application for an immigrant visa under 203 (b)"
203 (b) refers to the I-485 I believe?

They may have received the packet on July 2nd but the "official" Recevied Date is the date on which the actual data entry is made.
I think so too, my status says that my case was received by Nebraska Centre on Oct 10th.
I am current, but I do not know if my RD is in August when they received my application first or Oct 10th when Nebraska Centre received it later.

I got this information incase anyone was looking for it as well -
One can get an X-ray done with the skin test if there are chances of it coming +ve (generally for people from India). X-Ray validity is 6 months so if you have taken a X-ray in the last six months, that would count too.
Can one take a chest X-ray prior to TB test since it is highly likely for a person of Indian origin to test positive?
Also, does an X-ray taken in the last 6 months count or should this be taken in the week/month of the TB test?
Please advise.

guys, I don't know who got this information about the returning applications after august 17th...
But in USCIS website read frequently asked Q&A
reads like this.... never said any thing about the returning,
Q14: USCIS July 17, 2007 press release stated that USCIS would accept applications filed not later than August 17, 2007. Does this mean applications delivered on August 17, 2007 will be accepted but those arriving August 18, 2007 will be rejected?
A14. Yes

But in a true labor shortage, Wadhwa notes, "salaries should start shooting through the roof." .
Not commenting on the whole article, I'd like to comment on the single argument mentioned above. It's a much abused one by anti-immigrants.
Basic Idea: Using the law of demand-and-supply, it's argued that if there were real labor shortage in the country in any field, salaries in that field will simply rise to bring demand and supply in equilibrium.
So what's wrong with the argument: The law of demand and supply is essentially correct and works very well. The trouble is that this is where the story starts, not where it ends. The reality is that salaries find ceilings for a lot of reasons other than the pure demand and supply.
Let's take an example: Go to any supermarket and notice the number of cash registers manned by cashiers vs. the unmanned ones. Supermarkets don't build all the cash registers with the hope of having only a quarter of them occupied with customers lines getting longer and longer.
There's a genuine shortage of cashiers and supermarkets will absolutely love to have twice as many, if not more of them available to hire. Who wouldn't like to go to a supermarket where you don't have to wait 15 minutes in a line even at peak times?
So, what's the problem? Shouldn't it be easy... just increase the salaries...
Well, let's dig deeper. A supermarket hiring new workers at the higher salaries will have to pay that higher salaries to all the cashiers. Supermarkets operate at a typical profit of margin on 2%. A supermarket paying higher salary will simply be uncompetitive. The only practical solution to get as many workers they can get at the prevalent salaries.
Coming back to the context of hi-tech industry, There are a lot of reasons that salaries will not sky-rocket even if there are no workers:
It may make more business sense to simply cancel a project than to get it done at a sky-high labor cost.
The higher is the labor cost, the more attractive is outsourcing.
It may also be more attractive to water down to project to use less labor and keep costs in check than to pay sky-rocketed salaries and make it unprofitable. All these factors impose the limits on salaries and prevent them from sky-rocketing. It's not that employers are evil and don't want to pay a deserving worker; the bottom-line is that it has to make business sense too.
The law of demand-and-supply works very well for basic needs. After all, you'll buy staple food no matter what the cost is. Real estate will go very high if supply is low; homelessness is not an option. In contrast to that however, there are many options in a high-tech project other than to let the salaries sky-rocket.
For the reasons given above, using the law-of-demand and supply to refute the lack of workforce idea is Not a well reasoned argument but a hollow, simplistic application of it; Sadly, believable enough to be bought by many.

Does it mean that we are done?
Well .. your guess is as good as mine. I haven't heard anyone talk about us or even acknowledge the fact that legal immigration is broken to a point where it's becoming simply hopeless. In fact I believe it was Kennedy who said that there is no need to improve the current legal immigration system. There was hundreds of hours of discussion on the TV about the immigration but I hardly heard anything about the reform in the legal immigration system. America's fascination and love with the illegals probably has created the problem of illegal immigration today as we see it. Good luck solving it.
Time and again illegal folks have been given the benefit of the doubt and awarded with amnesty. When was the last time U.S. government said that okay legals.. you don't have to wait in line for half of your life to get your GC... here it is and now go have fun.
