I traveled last month on AP. Absolutely no issues. Very nice IO at POE at EWR airport.
I could see many folks in H1 and AP. Everyone was being stamped pretty fast in various queues around me.
Its all case by case. We really can not generalise the issue. I know one of my friend, every at POE he is taken for an interview and it happend 4 times so far. Its just him but not with every one.

Work toward your marriage and visa.
Then get medical done here. The dates will be current till Ag 20th 2007. After that it is anybody's guess.
Take one bite at a time and swallow it. Else you will get choked.
Aug 20th? The visa bulletins are valid for a whole month. So it will be current till July 31st or Aug 31st or something like that. Definitely not some mid month date like Aug 20th.

I arrived from Newark with my family around 10 days ago.
I have H1b and AP. I decided to use H1B to enter. Not a single question asked.
DHS officer was very polite and helpful. I forgot to fill two forms. I filled one and he filled the other one for me !!

I landed in Canada as a PR on Apr 4th. I had to return to the US to finish some stuff before taking a vacation and the experience was unforgettable. At the US border office I was quizzed (more like beat up)for about a half hour. The US officer in charge made a copy of my Canadian Landing paper and said that I can't have residency in 2 countries. He said that he was going to stop my residency process in the US, in spite of the fact that I have not even started the US green card process (Labor certification pending) and had applied for Canadian PR at least a year before my employer applied for my labor cert (changed employers). I thought that he would refuse me entry to the US, but luckily after a lot of pleading that I need to finish things up in US, he gave me entry. I repeatedly asked the officer who gave me the I-94 as to what effect will this have on my 140 and potential 485 to which he replied "Your processing is done. You need to leave or we are going to call the cops"
So all of you guys/girls with AOS pending, beware, these are not good times to land in Canada with a PR. I think IV members in every state has to come together and meet the congressmen/congresswoman and submit a letter and voice our problems due to retrogrssion.
This generic talk of "we need to do something" is not working I feel. I mean to say there are not many people who are really "taking things into their hands". Most of them are just curious readers.
If people who are affected by retrogression in every state come together and meet the senators I believe it will be worth it.

Sorry for missing the action this week. I have been busy with exams and classes. I will be free finally at the end of this month. Whenever I get time, I will be making a presentation compiling facts/data and other stories regarding this issue. I will also include my story in to this presentation. I will need you guys to review it and add new info/stories. We can present this to media/senators/general public/youtube/twitter/facebook. Even though we are small in number we can make a voice. Is it a simple majority which determines if the bill is to be sent to the House floor? Or 2/3?
The committee will discuss the text of the bill. Any objections from the committee members on the language of the bill will be amended (through amendment) so that everyone is happy with the text of the bill. The session will end with a vote which will decide if they want to send the bill to the House floor.

I don't think the response is correct. Question 12 only applies to people with unreported taxable income. Question 9 is the more appropriate one. And as per this, all you need to file is the 'delinguent FBAR' along with explanation for late filing.
And IRS will NOT impose penalty for failure to file the FBARs.

This is a typical divide and rule policy. When it comes to the undocumented immigrants, they say that they support legal immigrants. When the time comes to support the legal immigrants cause, they say that H-1B has to be reformed.
For people to assume that all the big corporations are going to agree to these changes to the H-1B program and quickly get this implemented, and given that this is going to have an adverse effect for these corporations, I dont think it is happening. Why would they pump in more money into lobying efforts for such a thing..
Even with the support of these corporations and their money, we have yet to achieve our goals (which we will very soon). Remember, this is not an utopian world we live in. Nothing is perfect, big corporations are big corporations and their bottom line is their revenue and earnings. We need to work with them to reach our goals.
Coming back to Sessions. What is his importance going to be in a democratic controlled senate? Very little to none! Right now, we had strong anti-immigrant forces occupying key leadership roles, yet, we came so close to achieving our goals. Imagine, when these people are all gone, and corporations including the nursing lobby are going to be making another big push, with none of these folks around, there shouldnt be much of an issue.
Its just a question of time. Its only when not if!
For those who want to contact Sessions and get his help, please feel free to do so, but to expect anything positive out of it would be naive. Actions speak louder than words. My being on H1 has nothing to do with you tryin to bring a Nanny, I am not on a Nanny visa or am I? Can i be your nanny at $65 an hour? jeez.
If you are trying to bring a Nanny to pay her $1000 a month plus airfare and 6 months of vacation and admit her to a local college for education and groundwork with your lawyer to complete the process, go ahead and do it.
I would still say it would be illegal. or you can try to ger borderline legal.
1) If you want to help that person, sponsor her or her childrens education. You are not helping anyone by sponsoring an underpaid worker. How would you feel, if your employer asks you to work for $20K a year just cos you did not have any other opportunity?
2) Sponsor the kid, do some good work. without exploitation.
3) If you want someone to understand your culture, you belong where your culture belongs, right in the very mother-land where you come from, cultures dont get exported out.
4) What you are tryin to do is illegal too, more illegal than the so called illegal you are talking about.
India is a country of a billion people, and you are trying to tell me the story of a downtrodden or a poor soul. and what are you trying to do to help?

If your kid gets sent back from the day-care bcos he sneezes, hire a nanny.
She will take care of the kid at home, and believe me, nannies do moderate house work too, alojng with taking care of the sneezing kid, also does dishes, does the laundry and stuff.
Let me introduce you to a term called PPP(purchasing power parity) google it and see why you should not expect to earn something and spend something else.
Believe me, many of us are in the same situation as you are and everyone of us know of some poor person in india who is deperately in need. And we want a solution too, but the one you want, is wrong..

1) I want a person who is making 100 $ per month to earn more (atleast 1000 $ per month ...right??)
2) If she would come here, she can support her family and some day her boy can come here for study or something....
3) I want somebody who understands my culture and the way i want to raise my kid.
4) I can get somebody from new jersy but mostly i would get illegal migrant...which i am not comfortable with.
Apart from my personal reasons, one simple economic rule, if you can get cheap labor, you don't want to spend more....that's why cos hiring you instead of American citizen,and outsourcing working great....
I really like your theory of "husband with cribbing wife", but unfortunately i m the wife, who is working 40+ hrs with fortune 500 company and planning to start her own company, whose husband keeps travelling (consulting) as he cann't change his job until GC.
With all odds working against me, I want peace of mind that my kid is in the safe hand, He is not sent back from certified day care only because he is sick...
And if i tell the story of the femal whom I wants to bring here....you would start crying...:-)....

I feel your pain. This is total BS. I would suggest get an infopass appointment and narrate your story to the person you talk to and see if they can help get it moving. I have known of people in the past who have benefited from meeting an immigration officer in person.

It makes it more frustrating as more than 5 people in my office started the advertising phase in Arpil and completed labor cert by June.
Has anyone else had a similar problem at this stage of the process. After 6 years I am still not through the first stage of labor cert and the patience is running low.

Three of us from your NumbersUSA Capitol Hill Team met in Capitol leadership offices this afternoon to get more details -- and to deliver our own message of what we believe most Americans want.
House Republican leaders felt they had to come out swinging after the New York Times earlier this week said they and Senate leaders had come back to Washington after summer vacations with no intention of dealing any more with immigration.
Public reactions to that kind of do-nothingism were explosively negative.
When I was interviewed by the Lou Dobbs show on CNN Tuesday, I was asked what the Republican leaders should do that would make political sense to them. My response was that House leaders should re-pass the key enforcement elements of the H.R. 4437 bill the House passed last December and then force Senate Republican leaders to bring those elements to a vote. I said there was nothing to be gained and much to be lost by dealing with any other issue, such as guestworkers, amnesties and legal immigration increases.
It looks like some other people had the same idea, because that essentially is what the House Republican leadership promised this afternoon.
Although it is doubtful Congress this fall would pass most of the enforcement measures needed to tame our out-of-control illegal immigration, there now appears to be a decent chance to get several first important new steps enacted. in this email:

2. THE 2-WEEK TIMETABLE
Incredibly, Congress is planning to be in Washington only two more weeks.
Is it really possible to get something passed and to the President's desk in that short time?
House GOP leaders are planning to hold a public hearing next week that will get the reports from all the committee chairmen who held hearings across the country this summer.
You will recall that the House GOP leaders refused to appoint a team of negotiators to work with Senate negotiators to come up with a compromise between the Senate amnesty/giant immigration increase and the House enforcement bill. Instead, those leaders pulled one of the boldest actions I've seen since I arrived in Washington in 1987: They sent chairmen across the country to pick up more testimony.
The knock against this was that it was all show but would lead to nothing in the fall.
Now, the House leaders are saying that they are going to see to it that the hearings lead to legislation that would be brought to the floor in two weeks.
Here is what Speaker Hastert said today:
"Our borders are a sieve and we are at war and we certainly need to act like we are at war. We need to close our borders."
Somehow, the enforcement measures may be passed and then wrapped up in appropriations bills that may not finally be passed until after the November elections. Or they may get through the Senate and be put before President Bush for his signature. We'll be following this closely.
Extremely important to be included are:
1. As much fence as possible on the border.
2. Mandatory verification for all new hires in all businesses.
3. Federal assistance of local communities trying to rid themselves of illegal alien populations.
4. An end to handing out hundreds of thousands of green cards and work visas without properly running the foreign workers through security clearances.
3. THE 3-MONTH TIMETABLE
Regardless of what happens this month, Congress seems likely to return after the elections in November and maybe early December to approve remaining appropriations bills.
This lame-duck session is extremely dangerous.
We know that the business lobbyists are putting incredible pressure on Members of Congress to slip terrible things into the giant omnibus appropriations legislation that will be considered in the lame-duck session.
The push is for large increases in green cards for permanent foreign workers and in H-1B temporary visas primarily for foreign workers who will take jobs from and lower the wages for American nurses, engineers, programmers and other skilled workers.
If these things get slipped into an appropriations bill, there will be no way to get them out.
That is why we must continue to mobilize and rally throughout the October campaign season to persuade congressional leaders that they will pay a price if they come back after the elections and harm American workers and communities in ways that they are promising not to do during the campaigns.
We made this point this afternoon at the Capitol.
We said that we will mobilize massive opposition to any politician who works hard to fight illegal immigration before the election but then turns around after the election and increases worker/wage competition against our own American workers.
The motto must always be LESS IMMIGRATION OF ALL KINDS. We cannot win the fight against illegal immigration (which primarily hurts lower skilled American workers) and then allow Congress to undercut and even destroy the economic lives of our more highly skilled American workers.
We must stand together and defend the ability of all of our fellow Americans to make a decent living in their occupations without the government threatening it with immigration -- and defend the ability of all Americans to protect their quality of life in their own communities from being overwhelmed by immigration.
We will continue to provide you with ways to pressure on these points.
All pressures on elected officials (as well as on the media, corporations and other institutions) create an overall climate in which progress can occur.
And there is no doubt that all of you -- and citizens like you across the country -- have brought about this new "September opportunity" by your incessant pressure for true immigration enforcement and reductions.
4. A NEW YORK TIMES ARTICLE THAT SHOWS THAT YOUR CITIZEN ACTIVISM IS WINNING
I can't think of another article that more completely shows the victory that all of your citizen activism is bringing to this country.
This article suggests the following very positive trends:

3. Candidates of both parties are having to distance themselves from their open borders leaders, such as Republican Bush and Democrat Pelosi.
This movement for overall immigration reductions is 26 years old now.
As a newspaper reporter, I covered this movement from 1979 through 1990. I've worked full-time since 1990 writing books, researching for scholarly journals and then forming NumbersUSA in 1997 to deal with this issue.
I can tell you that I have NEVER seen a time in which the political winds were blowing more favorably for us.
This is the time to put all the activism we can to push through the first steps of positive solutions for our communities and our country

Help House leaders pass several measures to tackle illegal immigration
ANOTHER CHANCE IN CONGRESS
TO TACKLE ILLEGAL IMMIGRATION
1. PUBLIC DISPLEASURE WITH 'NO ACTION' PROMPTS HOUSE PLEDGE TO TAKE FIRST STEPS
Speaker of the House Dennis Hastert this afternoon announced that true immigration reform is back on the agenda this month!
Three of us from your NumbersUSA Capitol Hill Team met in Capitol leadership offices this afternoon to get more details -- and to deliver our own message of what we believe most Americans want.
House Republican leaders felt they had to come out swinging after the New York Times earlier this week said they and Senate leaders had come back to Washington after summer vacations with no intention of dealing any more with immigration.
Public reactions to that kind of do-nothingism were explosively negative.
When I was interviewed by the Lou Dobbs show on CNN Tuesday, I was asked what the Republican leaders should do that would make political sense to them. My response was that House leaders should re-pass the key enforcement elements of the H.R. 4437 bill the House passed last December and then force Senate Republican leaders to bring those elements to a vote. I said there was nothing to be gained and much to be lost by dealing with any other issue, such as guestworkers, amnesties and legal immigration increases.
It looks like some other people had the same idea, because that essentially is what the House Republican leadership promised this afternoon.
Although it is doubtful Congress this fall would pass most of the enforcement measures needed to tame our out-of-control illegal immigration, there now appears to be a decent chance to get several first important new steps enacted. in this email:

2. THE 2-WEEK TIMETABLE
Incredibly, Congress is planning to be in Washington only two more weeks.
Is it really possible to get something passed and to the President's desk in that short time?
House GOP leaders are planning to hold a public hearing next week that will get the reports from all the committee chairmen who held hearings across the country this summer.
You will recall that the House GOP leaders refused to appoint a team of negotiators to work with Senate negotiators to come up with a compromise between the Senate amnesty/giant immigration increase and the House enforcement bill. Instead, those leaders pulled one of the boldest actions I've seen since I arrived in Washington in 1987: They sent chairmen across the country to pick up more testimony.
The knock against this was that it was all show but would lead to nothing in the fall.
Now, the House leaders are saying that they are going to see to it that the hearings lead to legislation that would be brought to the floor in two weeks.
Here is what Speaker Hastert said today:
"Our borders are a sieve and we are at war and we certainly need to act like we are at war. We need to close our borders."
Somehow, the enforcement measures may be passed and then wrapped up in appropriations bills that may not finally be passed until after the November elections. Or they may get through the Senate and be put before President Bush for his signature. We'll be following this closely.
Extremely important to be included are:
1. As much fence as possible on the border.
2. Mandatory verification for all new hires in all businesses.
3. Federal assistance of local communities trying to rid themselves of illegal alien populations.
4. An end to handing out hundreds of thousands of green cards and work visas without properly running the foreign workers through security clearances.
3. THE 3-MONTH TIMETABLE
Regardless of what happens this month, Congress seems likely to return after the elections in November and maybe early December to approve remaining appropriations bills.
This lame-duck session is extremely dangerous.
We know that the business lobbyists are putting incredible pressure on Members of Congress to slip terrible things into the giant omnibus appropriations legislation that will be considered in the lame-duck session.
The push is for large increases in green cards for permanent foreign workers and in H-1B temporary visas primarily for foreign workers who will take jobs from and lower the wages for American nurses, engineers, programmers and other skilled workers.
If these things get slipped into an appropriations bill, there will be no way to get them out.
That is why we must continue to mobilize and rally throughout the October campaign season to persuade congressional leaders that they will pay a price if they come back after the elections and harm American workers and communities in ways that they are promising not to do during the campaigns.
We made this point this afternoon at the Capitol.
We said that we will mobilize massive opposition to any politician who works hard to fight illegal immigration before the election but then turns around after the election and increases worker/wage competition against our own American workers.
The motto must always be LESS IMMIGRATION OF ALL KINDS. We cannot win the fight against illegal immigration (which primarily hurts lower skilled American workers) and then allow Congress to undercut and even destroy the economic lives of our more highly skilled American workers.
We must stand together and defend the ability of all of our fellow Americans to make a decent living in their occupations without the government threatening it with immigration -- and defend the ability of all Americans to protect their quality of life in their own communities from being overwhelmed by immigration.
We will continue to provide you with ways to pressure on these points.
All pressures on elected officials (as well as on the media, corporations and other institutions) create an overall climate in which progress can occur.
And there is no doubt that all of you -- and citizens like you across the country -- have brought about this new "September opportunity" by your incessant pressure for true immigration enforcement and reductions.
4. A NEW YORK TIMES ARTICLE THAT SHOWS THAT YOUR CITIZEN ACTIVISM IS WINNING
I can't think of another article that more completely shows the victory that all of your citizen activism is bringing to this country.
This article suggests the following very positive trends:

and no, I am not making fun of the folks who posted this , I am just frustrated that they have to find out all means to extract money from us, but do not want to give us GCs. (I know IRS and USCIS are different bodies).
