Hi Gurus,
I need some help with my situation:
After 5 years of waiting, my Labor got finally aproved thru Dallas BEC(EB3, RIR, PD: Oct'02). But my wife is in India on vacation and as per original plan will return middle of August.
1. What are my options so I can take advantage of the PD being current for me?
2. can I apply for I-140 and I-485 and then apply her I-485 when she returns?

As per my knowledge, ask your wife to come back from India and file I-485 along with your petition by before Jun 30, 2007.
If you want to wait till she comes back from India you can, but at that time (in Aug ) Cutt-off dates should be current to your PD date, If not you CANNOT file I-485 to your wife.

As per my knowledge, ask your wife to come back from India and file I-485 along with your petition by before Jun 30, 2007.
If you want to wait till she comes back from India you can, but at that time (in Aug ) Cutt-off dates should be current to your PD date, If not you CANNOT file I-485 to your wife.

Those cases are void at least per DOS. If you look at last month (or prev 6 months) demand data from DOS .
Demand Prior to Jan1st 2006 for EB2 I/C = 0
Demand data reflects the latest and accurate. (at least this is the document DOS relies on to set the priority date in VB)
Nothing is void, unless the application(i485) is denied. If we compare Oct 2010 inventory with Jan 2011 inventory we see changes in monthly pending cases before 01/01/2006.
DOS look for approvable cases in a particular month, as opposed to USCIS look at overall pending cases.:)
The bottom line is how one is interpreting the data/information available? We really don't know how DOS is interpreting USCIS pending inventory when publishing their demand data.

This is the same draft (I just changed the Dear.... senator./congressman/USCIS Assistant Inspector) for each and every email I sent out.
Congressmen& Senator needs faxed copies with Date and Sign on it.

There is nothing called h1b jobs. There is no job reserved for someone on h1b. So to say that people on l1 are taking h1b jobs is kind of funny.
At the same time, that anti-immigrant l1fraud is here to scare people and is against the community. But because most people here are not on L1, so most people are agreeing with l1fraud user. As if L1 folks are getting ahead of us, and L1 folks are taking our jobs, same mentality and outlook as that of the disgruntled programmers at programmers guild. Maybe there is nothing wrong about that because, humans as species have always behaved as part of the food chain, eating and living on the ones below us. Likewise, people here just want to blame someone else for their problems, including delay in GCs, on others on L1. So the entire focus of this thread is "l1fraud". From time to time, some anti-immigrant or someone from another site come in and divide people here without much of an effort, that we are just a bunch of losers, yes that's right, people who play into the hands of anti-immigrants and people who play into the designs of the agents of other agenda's are nothing but losers. My PD is sept 2001. India. I would like to know if i can file I140 and I485 concurently? My attorney says I can. Only thing they will not do anything with 485 until the visa numbers become current. Is this true?

Isn't it part of her job? There is nothing like being servant. Moreover, it was just asked to rinse the bottle with hot water, to be sure it is hygenic, in a circumstances when baby was making tantrums. Another reason for asking was because bathrooms were full, otherwise there wouldn't have been a need. We have travelled many other airlines, and there was never an issue for such requests. Many airlines go extra mile to please you. It is what is called customer service.

She has two duties on the plane, in order:
- safety of the passengers. this is #1.(ensuring luggage is stowed, seatbeats are on, people are not wandering around the aisles; co-ordinate and help in case of emergencies)
- basic service (serve food, clear the trays, handle simple requests like juice/water, ice barfbags etc). This does not include cleaning out your babies bottles. Some airlines have stewardesses who would go out of their way (I have seen Singapore Airlines do this) but again, rinsing a baby's bottle is NOT part of her job. She can get you a bottle of hot water if you want and you can rinse it yourself either in the sink or into the barf-bag.

I tried SR, Senator help, infopass without much help. 2 days ago when called, Texas POJ, one nice IO told me case is not yet assigned to officer, will send email, looks like worked this time. BUT this could be just incidental. Thanks IV. I have updated the profile. I only received the email, no text message.

Please don't undercut the Flower campaign. We need to give time for this to percolate through the main stream media. Please please please don't start delivering all kinds of things to USCIS. My two cents!

I have a copy of my approved I-140, and the only number I see on it is Receipt Number at the top left side of the notice. It reads like LIN-xx-xxx-xxxxx.
Is this the A# number you are referring to?
That is your receipt number. In my case, the A# is in the box that has the name of the beneficiary.

I also spoke to Terry at NSC once. She is very nice and will try to tell you as many details as possible.
@ Alterego: Dude, when the responses you are getting are basically "under review, wait 90 days", it is much nicer to know details like storage area, exam area, and where your file is.

This feeds to rumors and incorrect information circulated on forums. While such information helps generate lot of threads, page views and ad revenue for other websites, As an organization we should be cautioning people about this.
On the donor forum we have posted some tips what you can do get your greencard. There is no need to make calls everyday trying to get status. If your application is outside processing time, you can simply open a service request. There are other options like Ombudsman and local Congressman's office. We have also posted to our members that if if you have tried all options everywhere and you are in a desperate situation, Immigration voice will help its continued donor members.
In my opinion posts such as "storage area, exam area, and where your file is, pre-approved" only drive curiosity and mass calls that will not help processing of your case. We as an educated and mature community should not fall for such information on the forums.

I am so emotional now........just got the email, text message and message on the website changed to "Decision"
Mine, my wife's and my son's cases APPROVED!!!!
My case was in NSC. No additional fingerprinting, except one in Oct 2007, my son had to do one since he turned 14 this year....
14 years of wait is over......Praise be to God for his faithfulness and mercies

Folks,
Got the email about being registered as a new permanent resident on Oct 8th. Thanks to SoP, caliguy, fatjoe and all others on the forum who helped / gave me support. I essentially learned that USCIS will not move quickly on their own, they need to be pursued just like any other govt. office in India. I give my time line below for an idea of what I did. If anyone is waiting still, I sincerely think that you should do all of POJ/SR/Infopass/Senator/Ombudsman.
Timeline:
Sept 1st - became current
Sept 5th - contacted NSC several times through POJ. Finally, a very nice lady told me that my case was not even assigned to an officer. Said that she will send in a request to the contractor to pull my case out and get it assigned to an officer.
Sept 11th - Case pulled out of storage area and moved to a smaller waiting room [got this info later, but this is what had happened]
Sept 13th: Opened SR.
Sept 18th - Infopass: Told me that my case was assigned to an officer on Sept 11th (which was wrong really) and that I should wait 30 days. Also told me that my FP were renewed on March 9th and all my checks were clear.
Sept 20th: Contacted Senator's office. Said they will send in inquiry.
Sept 25: Response to SR. Case under review. Wait 30 days.
Sept 27th: Letter from Senator saying my case was under review and I need to wait 30 days.
Oct 2nd: Contacted NSC again through POJ method. A nice lady, Terry, told me that my case was assigned to officer on Sept 30th. She said, "your case was pulled out of storage and put in a rather large holding area where it was till Sept 30th." Also confirmed that my FP was renewed and other checks were clear. Said, just wait, it will happen soon.
Oct 6th: Sent 7001 form to USCIS Ombudsman.
Oct 8th: Got decision email.
Learnings: Pursue your case as much as you can. Call NSC, but be polite. They are usually in good mood on Thu/Friday evenings and if you make some small talk, they will help you. I kept records of which NSC IO is rude and if they picked up the next time, I would just keep the phone down. In fact, the lady who helped me remembered me 'coz I managed to reach her 3 times. Dont just ask for status, say that you have called in the past and so far you know xxxx about your case. Some IOs are nice, some are rude. Nice ones actually tried to explain the entire storage area, holding area, supervisor supply chain to me. I think I kind of understand the process that happens at NSC just through these conversations now. Approach Ombudsman asap with form 7001. Call your Senator office and ask to speak to the immigration person. They are very understanding and will help you.

I wish I had all the data on his reporting for H1B visas. He always makes it sound like there is unlimited H1B visa available for foreign workers and nothing can be further from the truth.
I hate to watch his show anymore but I'll from now on just to report the lies and inconsistencies he reports in his program. Let's do a "Expose Lou" campaign. I would love to spend any free time I have on this noble cause.

Its been over 3 hours now that I informed CapitalOne that the discrimination is illegal. And as expected, no reply received yet.
You scared the HR. He/she would have never thought you will get back to them with this info :D
I was talking to a reqruiter the toher day and he told me of a case where he placed a candidate with EAD and within weeks the EAD expired and the renewal did not come in time, though they managed to clear out the issue, the company seems to be uncomfortable dealing with the EAD shit, thats what he told me.

Can somebody frame a letter that we can use to report L1 fraud. And, folks its big companies like accenture and hewitt too exploting loopholes in L1. in my current place, most of experienced workers will be replaced by folks on L1. I dont want to come across as negative. My only point is if there are any violations, lets report it and have everybody follow the rules and regulations...

I was pleasantly surprised, although looking back at it, this was going to happen. The Indian media would have immediately tried to cash in on the news and interview the people associated with the movie.
Nevertheless, this is good news, and I wonder if we should try to capitalize on it. How?
If IV can get "IV merchandise" (T shirts, caps, etc) signed by a Boman Irani or a Rajkumar Hirani (and perhaps also embossed with a standard message that we all included with the flowers), and put it up for sale (on ebay etc), it might help to
1. spread the word on this issue
2. raise money for IV!
What do you think? Is this feasible? If it is, we should go for it as nothing matches Bollywood when it comes to spreading a message.
