Let's give them one more month. I just hope that if they are using LIFO now (latest application received being entered into the system), they should also use LIFO in processing the cases, meaning the last case entered (probably an early July filer) will be the first one to be processed.....just a wishful thinking.

In my opinion it is very naive to think that USCIS/DOL just realized that they had 'misinterpreted' the law. They had made it very clear how they allocated 'available' visa numbers after AC-21 was introduced, and I am sure they consulted with the law-makers.
It's almost funny to read that they consulted with today congress. How would they now of the intentions of the congress in 2000?
According to Ron's post, 70% are from India and China, and Mexico is also reaching the ceiling. They realized that the only way to shift those numbers is to give more visas to India and China. The ambiguity of the law for the preference of vertical vs. horizontal spill-over allowed them to do that.

Heard the same from my lawyer, she has changed her tune completely in 2 days. Now she says that she is hearing the same thing and is possible. They are working through the weekend and has asked me to keep my blackberry on me at all times as they will be providing emails updates every 4 hours or if and when the said bulletin is released.

Good news... I got CPO at 9:05AM.
I raised SR for my case on 9/2 and no response until today morning and raised SR for my wife yesterday night. No changes to my wife application.
I asked my attorney sending an e-mail for TSC streamline process and I do not know whether he acted on it or not.

My wife is in the same boat. Interviewed Jan 4th. in Mumbai and passport returned immediately - asked to resubmit passport after she received an approval email or phone call. I started a new thread here: <http://immigrationvoice.org/forum/showthread.php?t=16508&highlight=mumbai>

I have taken an infopass tomorrow to get the I-551 stamp on my passport. Once that is done I will be mailing out the form I-90 for replacement.
What is this I-551 stamp ? Is stamping that mandatory ? What kind of documents do you need while you go for this stamping ?
If one does not plan on travelling until we receive the physical Green Card - would we still have to do this stamping ?

The competitive angle did occur to me. There is no reason a business should not look for ways to cut costs. However, this is a question of fairness & legitimacy. A L1 visa person living in a low cost country and coming here temporarily on short-term assignments can make do with lower wages because he likely does not have to support a family here at the US cost of living, and L1 spouses can work. This is not fair to a H1 with same skills whose H4 spouse cannot work, and for the same reasons it is not fair to USC/GC folks. Isn't that why we currently have all this labor certification processes and DOL laws? Those laws are designed to level the playing field. It is not easy for the company to outsource entirely, so they break the law by abusing the visa. Why should we not act to stop this illegitimate corporate action?
If that does not sound reasonable, let me ask you this: Why should USCIS and law-makers even consider taking steps to address green-card backlogs, adding resources to process more cases more quickly when they can just sit there and collect fees from you for visa / EAD renewals?

If you want to go , complain against this L1 misuse fine, but you are not going to get mileage, maybe some bad breath and bad publicity and eventual loss of reference & job. can L1fraud hold his head high in front of his client and still ask for reference with no sense of guilt in future? If not, he has lost half the game but now wants to lose the other half in a self destructive manner.

We are still waiting for a response for our second application (filed in Aug). We had A#s on our I-140s so mentioned the same A#s on both applications and also noted in the second filing that one is already pending.

Well it is their country. We are serving through our volition.
We have an expectation, but in a free market it is demand and supply.
i am Not trying to be negative - just a reality check on where we stand and how we can approach.
It is a fact that immigration from Asia shot up at the turn of the millennium. This may look disproportionate to proponents of diversity.
Now 1/6th of the world population comes from one country. But the quota for Iceland and India remains the same.
Consequently many like us cannot: change employers, give up opportunities (lure of which we came here for) and wait for the same outcome that others achieve much faster, simply because they were born somewhere else or their employers & lawyer decided their immigration category. So much for free country and meritocracy.
i believe our main point should be a level playing field and transparent
system so that expectations are clear.
For those of us who have suffered due to lack of clarity, for all fairness, must lobby for a chance to parity after multiple (say 10) years of serving LEGALLY.

Specter And Frist Eyeing Each Other's Immigration Efforts
Signaling that the immigration issue faces a tough fight, the Senate Judiciary Committee is planning to produce a wide-ranging bill, while Senate leaders are poised to write their own legislation. A senior GOP leadership aide said Majority Leader Frist is operating on "two tracks" on immigration, waiting to see what the Judiciary panel produces "while being ready to act in lieu thereof to meet member interest of action on this bill."Judiciary Chairman Specter sounded confident that his panel would produce a bill that would wind up on the Senate floor. "The idea of having a leadership bill ... has been abandoned," he said last week. His panel will begin marking up immigration legislation March 2. A chairman's mark expected to be introduced this week will resemble the mark Specter circulated last year, which borrows components from various immigration proposals. It included the border security provisions in the plan introduced by Sens. John Cornyn, R-Texas, and Jon Kyl, R-Ariz., as well as the guestworker plan introduced by Sens. John McCain, R-Ariz., and Edward Kennedy, D-Mass.
Specter has characterized the mark as a "starting point" for debate.
Frist has told colleagues he wants to begin floor debate in late March, likely March 27. Senate aides said whether the bill will be written by the committee or leadership depends on how the Judiciary Committee markup goes. "If the committee keeps the bill solid, and if it gets it done on time, Frist won't need to introduce anything," one GOP aide said.
Frist, while touring immigration detention centers Tuesday in Long Beach and Los Angeles, said he opposes giving illegal workers amnesty, but said it was too soon for him to take a position on a guestworker program, which is likely to be the most contentious component of an immigration bill and has divided Republicans. The House passed legislation last year toughening border security and requiring companies to verify the legal status of their employees. Unlike the House bill, the Senate bill is widely expected to include some version of a guestworker program. The program included in the Kennedy-McCain bill would allow illegal workers to join a temporary guestworker program, after which they could be eligible for permanent citizenship if they meet criteria and pay a fine. Ok it too late for the letters..we need to focus on the HR bills by Resp Sen Lofgren..we have a narrow window here.. and bi partisan support..we can send her flowers and request the Senator to take this up seriously..also we can send the flowers to the co-sponsors..at thier local offices instead of DC ..since DC office is closed now..

I am sure that in India incarceration is very low because lot of criminals don't go to prison, instead they rise in politics like your leaders Advani, Modi , Laloo etc. (who would have languished in a prison in any other civilized country) and become prime-minister material. :D :D
Or are you planning to pratice some white-collar crime/fraud here after getting the coveted GC - like starting a "consulting company" to import indentured servants at dirt cheap prices? :D :D

What should be the answer to this question on I-485 part 2- out of following 2 options for my dependents ? to me it seems #b is the right answer for my family members 485 and #a for me. BUt some how teh legal guys are changing this from #b to #a for my dependents!!
